30. Unannounced Visit: Improper Restraint

Improper restraint used on resident.

Investigation Findings
Licensing Program Analyst (LPA) made an unannounced site visit to the facility on this date for the purpose of investigating the above complaint allegation. LPA met with the administrator and explained the reason for this visit. During this visit, LPA toured the facility to observe if there are any residents with restraints. During the tour no restraints were observed. At the time of the visit, most residents were attending a day program and were not available for interview. LPA interviewed the office manager who informed LPA that there are two residents who have restraints when they sitting in their wheelchairs. LPA conducted a file review of each resident’s file to find a prescription from a physician giving approval for the use of restraints. The files reviewed did not have any documentation approving soft ties/restraints. LPA discussed with the administrator the procedure for obtaining approval for restraints to be used for resident safety and support. Based upon information obtained during this visit, the allegation is deemed substantiated. According to the California Code of Regulations, Title 22, Division 6, Chapter 8, the following deficiency is cited: See LIC 9099-D for citation. Appeal Rights Discussed and given. Exit Interview was discussed. Report was issued.

87608(a)(3) Postural Supports. A written order from a physician indicating the need for postural support shall be maintained in the resident's record. The licensing agency is authorized to require additional documentation if needed. R1 & R2 have wheelchairs with seatbelts attached without a physician's order on file.Administrator will submit plan of correction to LPA by POC due date. Administrator will ensure restraints are only used with the proper physician's order.

Personal Rights. Each resident shall be accorded dignity in his/her personal relationships with staff, residents and other persons. Each resident shall be accorded safe, healthful and comfortable accommodations, furnishings and equipment.
Each resident shall be free from corporal or unusual punishment, humiliation, intimidation, mental abuse, or other actions of a punitive nature.
R1 and R2 are restrained in wheelchairs with seatbelts.
Administrator will submit a plan of correction regarding the proper use of restraints and ensure that resdents have physician's approval on file.
